1. General

These general terms and conditions apply to all quotations, orders, sales and deliveries made by Atelier Orée Antwerp, both to private customers and professional clients.

By placing an order or accepting a quotation or order form, the customer confirms having read and accepted these general terms and conditions.

Any deviation from these terms is only valid if agreed upon in writing in advance.

2. Products and handcrafted nature

Atelier Orée Antwerp products are made by hand. Ceramics are natural, artisanal materials, and each piece is unique.

Minor differences in shape, dimensions, colour, surface, texture and glaze are inherent to the production and firing process and form part of the individual character of each piece.

Variations may also occur between samples, photographs, previously produced pieces and the final product.

Such natural and handcrafted variations are not considered defects or non-conformities, provided the product corresponds to the essential characteristics agreed upon.

Photographs, samples and images shown on the website, social media or other documentation are intended to be as representative as possible, but slight differences in colour or material may occur.

3. Quotations and prices

All quotations are non-binding unless explicitly stated otherwise and remain valid for the period indicated in the quotation.

Prices for professional clients are stated excluding VAT unless expressly indicated otherwise.

Prices for consumers are communicated including VAT in accordance with applicable legislation.

Any delivery, installation or other additional costs will be specified separately.

Custom work, larger quantities, hospitality projects and special executions are quoted individually.

4. Orders

An order becomes final once the customer has accepted the quotation or order form in writing and, where applicable, the required deposit has been received.

The order will be produced according to the specifications stated in the quotation or order form, including, where applicable, the model, size, ceramic finish, glaze, lampshade, fabric and other selected options.

The customer is responsible for verifying these details before final approval.

5. Deposit and payment

Unless otherwise agreed, a deposit of 50% of the total order value is required.

Production begins once the deposit has been received.

The remaining balance must be paid in full before or at the latest upon delivery, depending on what has been agreed in the quotation or invoice.

A different payment schedule may be agreed for larger projects.

6. Production time

As Atelier Orée Antwerp products are largely handmade and made to order, indicated production and delivery times are realistic estimates.

Ceramics go through several stages of production, drying, glazing and firing. Unforeseen technical circumstances may therefore occasionally result in a limited delay.

Atelier Orée Antwerp will inform the customer if an agreed delivery timeframe is expected to change significantly.

7. Delivery and collection

Collection and delivery are arranged personally and by mutual agreement.

For delivery possibilities, timing and applicable costs, please contact Atelier Orée Antwerp directly by message or email.

Products are always handled and transported with care and suitably protected.

8. Inspection upon delivery

Customers are requested to inspect the product upon receipt.

Any visible transport damage or clearly incorrect delivery should preferably be reported immediately upon delivery and confirmed in writing as soon as possible, where possible accompanied by photographs.

For consumers, this reporting procedure does not affect their statutory rights.

9. Cancellation and made-to-order products

Atelier Orée Antwerp products are handmade and production is organised specifically for each confirmed order.

Once an order has been confirmed and production has started, it can no longer be cancelled without consequence.

If a customer requests cancellation within 14 days after confirmation of the order, the 50% deposit remains with Atelier Orée Antwerp where permitted under applicable law and in particular where the product has been made or is being made according to the customer's specifications or has been personalised.

This deposit contributes to the time reserved for production, work already carried out and materials ordered or allocated specifically to the project.

For custom-made or personalised products that fall within the legal exception to the consumer right of withdrawal, no statutory 14-day withdrawal right applies.

Where a statutory right of withdrawal does apply, nothing in these terms limits the consumer's mandatory legal rights.

10. Statutory warranty for consumers

For sales to consumers, the statutory warranty applies in accordance with Belgian law.

For new consumer goods, the statutory warranty is in principle two years from delivery.

If a product shows a lack of conformity covered by the statutory warranty, the consumer may contact Atelier Orée Antwerp for the remedy provided for by law.

Nothing in these general terms and conditions limits the consumer's statutory warranty rights.

11. What is not considered a defect?

Due to the handcrafted nature of the products, the following characteristics are not in themselves considered manufacturing defects:

  • slight differences in colour or glaze;

  • variations in texture or surface;

  • subtle variations in shape or dimensions;

  • traces inherent to handmade ceramics;

  • minor differences between pieces from the same collection;

  • normal ageing of natural materials.

Damage caused by improper use, dropping, impact, unsuitable cleaning products, incorrect maintenance or use in conditions for which the product was not designed is not covered as a manufacturing or conformity defect.

12. Electrical and lighting components

Products are supplied with the electrical or cordless lighting components specified in the quotation or product description.

Cordless versions are supplied with two rechargeable light modules as standard, unless otherwise agreed.

Any stated battery life is indicative and depends on factors including light intensity, use, charge level and conditions.

Where technically possible, various models may also be supplied in a wired version if agreed in advance.

The customer must follow the supplied usage and maintenance instructions.

13. Use and maintenance

Although durable, ceramics remain breakable materials.

Products must be handled with care and used only for the purpose for which they were designed.

Maintenance should be carried out in accordance with the care instructions provided by Atelier Orée Antwerp.

Aggressive cleaning products, abrasives and other substances that may damage ceramics, glaze, textiles, metal or electrical components should not be used.

14. Indoor and outdoor use

Atelier Orée Antwerp lighting objects are designed primarily for indoor use.

They may also be used outdoors in good and dry weather conditions, for example on a terrace, during an event or for outdoor dining.

They should not be left outdoors permanently and must be brought inside in case of rain, high humidity, frost, strong wind or other adverse weather conditions.

Outdoor use remains the responsibility of the customer and must always take place under suitable weather conditions.

15. Professional and hospitality use

For products used professionally in restaurants, hotels, event venues, catering, rental environments or other hospitality settings, normal levels of professional use are taken into account.

Wear resulting directly from intensive or improper use, damage caused by third parties or use contrary to the communicated product instructions is not considered a manufacturing defect.

For projects, additional arrangements concerning quantities, replacement pieces, spare parts, service, installation and maintenance may be included in the quotation.

16. Liability

Atelier Orée Antwerp is responsible for the proper performance of the agreement and for complying with its legal obligations.

Atelier Orée Antwerp cannot be held liable for damage resulting directly from improper use, incorrect installation by third parties, inadequate maintenance, alterations made by the customer or third parties, or use contrary to the supplied instructions.

Nothing in these general terms and conditions is intended to exclude liability where such exclusion is prohibited by applicable law.

17. Force majeure

If Atelier Orée Antwerp is temporarily or permanently unable to fulfil its obligations due to circumstances beyond its reasonable control, such as serious technical problems, fire, flooding, exceptional supplier failures, transport disruptions or other events of force majeure, the customer will be informed as soon as reasonably possible.

The parties will then determine in good faith whether the order can be continued, postponed or, where performance has become impossible, terminated.

18. Intellectual property

The models, designs, forms, photographs, texts, drawings, prototypes, product names, graphic elements and other creative work of Atelier Orée Antwerp remain protected by applicable intellectual property rights.

The purchase of a product does not transfer any of these rights.

Products, designs or images may not be reproduced, copied or commercially exploited without prior written permission.

19. Photographs of completed projects

Atelier Orée Antwerp may request permission to photograph completed projects or use images of them for its portfolio, website, social media or other communication.

Such use will only take place where the necessary permission has been obtained.

Where a location, private residence or client is identifiable or specifically named, separate arrangements may be made where appropriate.

Atelier Orée Antwerp handles each complaint personally and will first seek to reach an appropriate amicable solution.

21. Applicable law

All agreements with Atelier Orée Antwerp are governed by Belgian law.

For consumers, this choice of law does not affect any mandatory consumer protection rights to which they are entitled.

In the event of a dispute, the parties will first seek to reach an amicable solution.

If no solution can be reached, the courts having jurisdiction under applicable law shall have jurisdiction.

22. Severability

If any provision of these general terms and conditions is found to be wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions.

23. Amendments to the general terms and conditions

Atelier Orée Antwerp may amend these general terms and conditions from time to time.

The version communicated to the customer or available at the time the agreement was concluded shall apply to that order.
